“Copyright Alliance Congratulates AAP For Opposing Unconstitutional State of Maryland eBook Licensing Mandates”

The Copyright Alliance has released the following statement from its CEO, Keith Kupferschmid:

We applaud the AAP for seeking to prevent the State of Maryland from creating what is in effect a compulsory license for literary works. Maryland law raises serious constitutional and copyright concerns. This is an alarming intrusion into the exclusive rights of copyright holders, and it sets a dangerous precedent that, if left unchecked, would threaten the wide range of creative industries that depend on copyright. author to support the production and distribution of creative works, including books, films, music, software, photos, newspapers and more.

The copyright community and the general public benefit from an effective and consistent national copyright framework, and we are deeply troubled by Maryland’s misguided encroachment into an area that is exclusively the province of Congress. We hope the court will soon recognize that Maryland’s effort to requisition the exclusive rights system that allows authors and copyright owners to create and distribute their works is at odds with the Constitution, U.S. copyright and the public interest.
